Charges for drug possession and drug possession with intent to sell have a statute of limitations. Like most felonies in California, the statute of limitations for drug crimes lasts for three years. Criminal charges cannot be filed against you for a drug crime more than three years in the past. Within three years, beyond just an accusation, there would have to be other evidence for the prosecution to consider building a case against you.
